Hazardous waste storage areas are among the most closely scrutinized areas during EPA and state environmental inspections. The Resource Conservation and Recovery Act (RCRA) under 40 CFR Parts 262 and 265 requires generators to properly manage, label, contain, and inspect hazardous waste containers throughout the accumulation period. Weekly inspections of storage areas are mandatory for large and small quantity generators. Violations related to container management, labeling, accumulation time limits, and secondary containment consistently rank among the most common RCRA enforcement actions. RCRA Generator Requirements — 40 CFR Part 262
- 262.17 (LQG): Large quantity generators may accumulate hazardous waste up to 90 days without a storage permit, provided all conditions are met including weekly inspections, proper labeling, container management, and emergency preparedness.
- 262.16 (SQG): Small quantity generators may accumulate up to 270 days (or 180 days if not transporting over 200 miles). Weekly inspections required. Maximum quantity on site: 6,000 kg.
- 262.14 (VSQG): Very small quantity generators may accumulate up to 1,000 kg. No federal weekly inspection requirement, but best practice to inspect regularly.
- 262.15: Satellite accumulation allows up to 55 gallons (or 1 quart acutely hazardous) at or near the point of generation under control of the operator. When full, must be dated and moved within 3 days.
Container Management Standards — 40 CFR 265 Subpart I
- 265.171: Container must be in good condition. If deteriorating, waste must be transferred to a container in good condition.
- 265.172: Container must be compatible with the waste stored in it.
- 265.173: Containers must be kept closed during storage except when adding or removing waste.
- 265.176: Minimum 15-meter (50-foot) separation between ignitable or reactive waste containers and the facility property line.
- 265.177: Incompatible wastes must not be placed in the same container or in unwashed containers that held incompatible materials.

Part 3: Storage Area & Containment
